Q. If medicare paid my medical bills for the treatment I needed due to someone's negligence, does Medicare get reimbursed for their payment? A. Yes. Under the Medicare Secondary Payer Statute when Medicare makes a payment for medical services received as a result of an injury caused by another party (automobile accident, medical malpractice, slip and fall etc) medicare has a right to recover the payments. Any payments made by Medicare must be accounted for because the law makes the injured party or their attorney liable to repay from any settlement.
