Limted tort is an election that the insured can make to limit his/her ability to collect damages in a lawsuit.  For the waiver of certain rights, the insurance companies give their insureds a modest savings on their premiums.  In essence, if you have elected the limited tort option you can only recover non-economic damages (i.e. pain and suffering, embarrassment, humiliation etc.) if you have suffered a serious impairment of a body function. There are exceptions to the limited tort waiver applying such as if you were injured by a drunk driver or injured by a driver driving a car registered in a state other than Pennsylvania.  There are other exceptions so it is important to consult an attorney familiar with the law to discuss your options.
