Was Carelessness A Factor In Your Pennsylvania Slip And Fall?

It's natural to blame a slip and fall on yourself before thinking that someone else might be responsible for your serious injury. However, in Pennsylvania law, there are specific ways of determine if your slip and fall injury was due to your own carelessness or due to the negligence of the property owner themselves.

If you have been involved in a slip and fall that resulted in a serious injury, you can ask yourself the following questions:

· Would a careful person have been paying attention at the time of your fall?

· Would another person have realized that the surface was slippery and walked more carefully so as to avoid a slip or trip?

· Would another person have noticed the spill or slick surface and stepped around it?

· Were you involved in an activity that made slipping or tripping more likely, such as running, roughhousing, or jumping?

· Were you distracted by something else at the time, such as another person, a cell phone call, or your child?

· Were there warning signs that the area you were entering was dangerous, or that there was a spill or wet spot?

· Were you in an area of the property where customers or visitors were allowed or welcomed?

· Did you have a good reason to be in the area of the property where you fell, and could the owner anticipate that visitors would be in that area?

It is often not difficult for experienced lawyers to prove that a slip and fall victim was not careless at the time of their accident, and even if you were careless to some extent, it does not mean that the property owner was also not negligent. In these cases, you may simply receive a smaller compensation if both the property owner and you were partially responsible for the accident.

These cases are rarely clear-cut, and slip and fall cases are often much more complex than injury victims guess. If you have been involved in a slip and fall and are seeking monetary compensation for your injuries, call us today for a no-obligation, confidential consultation.
