Medical Malpractice

When you are under the care of a medical provider, you rightfully assume you are receiving the best possible treatment.  Unfortunately, doctors, nurses, and hospitals are sometimes negligent and their mistakes can cause catastrophic injuries to patients.  If you have been the victim of medical malpractice, you may have a claim against the medical provider who caused your injuries and should be compensated.  You may be awarded a substantial settlement for your injuries.

Medical errors happen more often than people realize.  In 2006, there were over 6,800 serious incidents reported in Pennsylvania by health care facilities involving patient care according to the Pennsylvania Patient Safety Authority Annual Report for 2006.   These were events that involved the patient being harmed in some way, which resulted in a traumatic injury or even death.  However, there were only approximately 1,700 medical malpractice filings in the Pennsylvania courts that same year, according to the Administrative Office of Pennsylvania Courts. Many injured patients do not realize they have been victimized by medical malpractice.  Contact Steven F. Reilly, PC at (610) 272-7075 if you believe you have a Pennsylvania medical malpractice case.

What is Medical Malpractice?
The term “malpractice” is defined as a situation in which a medical provider fails to diagnose or improperly treats a medical condition.  In basic terms the health care provider did something that should not have been done or failed to do something that should have been done.  Often, negligence is involved.  A medical provider cannot be responsible for causing a preexisting condition, but if that provider was negligent in giving treatment, made the illness worse or caused a new ailment then that patient may have a medical malpractice case.  Malpractice claims can be brought against physicians, nurses and hospitals.

Some of the forms of medical malpractice include:

•    Misdiagnosis or failure to diagnose a medical condition
•    Correct diagnosis of ailment, but lack of appropriate treatment
•    Failure to obtain the patient’s consent for a performed procedure
•    Wrong medication prescribed to patient
•    Failure to properly manage and supervise a patient’s care

Medical Malpractice Claim
In many situations, it may be difficult for a patient to determine whether or not medical malpractice occurred.  That is why you need the help of an experienced medical malpractice attorney, such as Steve Reilly.  He has represented hundreds of clients who have been injured by medical malpractice in Pennsylvania.  Steve will review your medical records and give his expert opinion on whether it appears that medical malpractice was involved.

To have a successful medical malpractice claim, you must be able to show that you have experienced pain and suffering, lost wages, a permanent disability, disfigurement and/or emotional distress.  If you win your case, you may be able to recover a large cash settlement for these damages.  Steve Reilly will work hard to make sure you are compensated for your injuries.

You do not have to face the insurance company, defense attorney and defense experts alone.  Contact Steven F. Reilly, PC immediately after you have been injured.  Steve will thoroughly analyze your medical malpractice claim to help you build your case.  He previously worked as a medical malpractice defense attorney for 11 years and since 2000 he has been representing injured victims.  Steve can anticipate the tactics of the defense team as he knows how defense attorneys and insurance companies analyze and defend cases.  Medical malpractice cases are complex and require an experienced lawyer.

Steve reviews each claim personally and formulates the best strategy to win your case.  As a client of Steven F. Reilly, PC, you will receive personalized attention and be able to talk with Steve directly.  There are no upfront fees and you do not pay anything unless you win your case.  Some of Steve’s recent successful cases include the following:

  • Birth trauma resulting in cerebral palsy
  • Radiological and surgical malpractice
  • Malpractice involving appendicitis which led to the patient’s death
  • Misdiagnosis of cancer
  • Post-operative infection
  • Malpractice during eye surgery
  • Emergency room mistakes leading to patient’s death
There is a deadline as to when you can file a medical malpractice claim.  Therefore, it is advisable that you seek immediate legal representation after a medical malpractice injury as there are preliminary steps that need to be taken and data that needs to be collected to ensure a strong case.
